Terms and Conditions

Werners Visuals LLC, operating as Eva and the Planet, is a Florida-registered limited liability company in good standing, with international operations managed from abroad. By booking a trip and submitting your deposit, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, our Privacy Policy (available at evaandtheplanet.com/privacy (#), and our Liability & Media Release Waiver.
These Terms & Conditions (“Terms”) govern your participation in any travel experience (“Experience”) organized by Werners Visuals LLC. By booking, you confirm your explicit agreement to these Terms and the Liability & Media Release Waiver via a checkbox or digital signature on the WeTravel platform prior to submitting your deposit.
Eligibility
By booking a trip with Werners Visuals LLC, you confirm that you are at least 18 years of age at the time of booking. We do not accept bookings from individuals under 18. If you are booking on behalf of someone else, you confirm that all participants meet this minimum age requirement.
1. RELEASE & ASSUMPTION OF RISK
We build every trip with care. We scout the places. We handpick the people. And we do everything to make sure your experience is memorable, safe, and seamless. Still, by joining one of our group trips, you acknowledge that travel—especially across international and unfamiliar destinations—comes with inherent risks. Travel is unpredictable—and some things are out of our control.
Our trips take place in regions where local standards of hygiene, safety, infrastructure, or medical care may differ from what you're used to. We always aim for comfort and quality—but we can’t guarantee outcomes or eliminate risks. We promise to be transparent about our partners and locations, and to be meaningfully available if something goes off plan. But you agree to take responsibility for your own wellbeing throughout the journey.
By booking and placing a deposit, you understand and accept that your trip may:
Involve inherent risks—all travel does.
Take place in areas where transportation, healthcare access, infrastructure, and cleanliness may not meet Western standards.
Include various activities and exposures (e.g., boat rides, local foods, different climates, wildlife, unfamiliar terrain, group dynamics, altitude changes, and cultural environments) that may be physically or emotionally challenging.
Occur in regions with higher rates of petty crime or street-level safety issues than you're used to.
Safety standards may differ, and local crime rates might be higher than what you’re used to.
By booking and paying a deposit, you knowingly accept and assume all travel-related risks—physical, logistical, emotional. You agree to release and hold harmless Eva and the Planet, Werners Visuals LLC, our local hosts, drivers, partners, and team from any liability or claims arising from your participation—unless caused by gross negligence.
This release applies to the fullest extent permitted by applicable law, acknowledging that local consumer protection laws in your country of residence may impose additional rights or obligations. This release applies to you, your heirs, your legal representatives, and any future claims. This section applies in addition to any other waivers or liability forms we may ask you to sign.
2. HEALTH & MEDICAL
Your health is your responsibility—and we need to know that you're able to fully participate in the experience.
Our trips take place in remote, rural, or developing regions where medical infrastructure, hygiene, and access to emergency care may be limited or delayed. Standards of care may differ significantly from what you’re used to. That’s part of the adventure—but also part of the risk.
By booking a trip and placing a deposit, you confirm that:
You are physically and mentally fit to travel and participate in all activities listed in the itinerary.
You have not been advised by a medical professional to avoid travel, high-impact activities, or changing climates.
You have provided written disclosure of any relevant medical conditions, injuries, allergies, or mental health concerns before booking, so we can assess together whether the trip is suitable. You consent to the collection and storage of such sensitive health information solely for safety purposes, as outlined in our Privacy Policy.
You understand and accept that medical services may be delayed, unavailable, or below the standards you expect at home.
You are solely responsible for all medical costs incurred during the trip—including doctor visits, medications, hospitalization, emergency transport, or evacuation.
You carry valid travel insurance that covers personal injury, medical treatment, hospitalization, and emergency evacuation. Proof of insurance must be submitted at least 45 days prior to departure.
We are not medical professionals. We cannot provide medical treatment or guarantee the quality or outcome of any care you receive. We will support you as best we can—but ultimately, your health and safety are your own responsibility.
Our experiences involve light-to-moderate physical activity, including walking, snorkeling, and navigating stairs or uneven terrain (e.g., near waterfalls). A normal level of fitness is expected. If you have any physical or mental conditions that could impact your participation, you must inform us in writing before booking.
Failure to disclose may result in cancellation of your booking without refund. If you choose to skip an activity for any reason, no refunds or credits will be issued for the missed portion. We reserve the right to request a medical certificate confirming your fitness to travel, or to cancel your booking if your health condition poses a risk to yourself or others.
By joining this trip, you voluntarily accept and assume all foreseeable risks associated with medical care access, medical emergencies, and physical demands of the experience. You also release and hold harmless Eva and the Planet, Werners Visuals LLC, our team, partners, and affiliates from any claims or liability arising from such risks—unless caused by gross negligence.
3. BOOKING & PAYMENT TERMS
A 20% non-refundable deposit is required to reserve your spot. Once it’s in, we start locking in accommodations, transport, and all the details that make your trip possible.
You can pay the remaining balance either in full or through a structured payment plan—but regardless of the method, the full amount must be paid no later than 75 days before your trip begins. If you book within 75 days of the trip’s start date, the total price is due immediately, in full, and is non-refundable.
All payments are processed securely through our third-party platform WeTravel. When you click “Book Now,” you’ll be redirected to their site to complete your booking. Depending on your payment method, you may be asked to provide your name, email, billing address, and payment details. This information is handled directly by WeTravel. Eva and the Planet does not store or process any payment data on its own website. By booking, you agree to WeTravel’s terms and conditions (https://www.wetravel.com/terms (#)) and privacy policy (https://www.wetravel.com/privacy (#)).
We do not accept bookings via phone, email, or in person. All trip reservations must be made through the WeTravel platform. All payments are processed in USD. You’re responsible for any currency conversion, banking, or third-party transaction fees.
Failure to complete your payment on time may result in cancellation of your booking without refund of any previous payments made.
Your booking is with Eva and the Planet (Werners Visuals LLC). We may collaborate with trusted local providers for accommodations, transportation, and other in-country services—but your payment and agreement are directly with us.
4. REQUIRED DOCUMENTS
To join the trip, you’ll need a few essential documents. Some are required by law, others by us—and it’s your job to make sure you have them all in time.
You must have:
A valid passport that’s valid for at least 6 months beyond your return flight date.
Any required visas, permits, or proof of vaccinations, depending on your nationality and the destination country.
Proof of valid travel medical insurance (see Section 14).
We’re happy to point you in the right direction—but ultimately, you’re responsible for understanding and meeting all entry and health requirements for the destination(s). Any info we share on visas, health protocols, climate, clothing, or packing lists is for guidance only. We’re not liable for errors, missed requirements, or consequences that result from incomplete or incorrect documentation on your part.
Proof of insurance must be submitted no later than 45 days before the trip start date, or within 7 days of booking (whichever comes later). Failure to provide valid documentation on time may result in cancellation of your booking—without refund.
5. MINIMUM PARTICIPANTS
All group trips require a minimum of 6 confirmed participants in order to run. If this minimum is not met, we reserve the right to cancel or reschedule the trip. In the rare case this happens, you’ll be offered a full refund or the option to transfer your booking to a future departure.
We’re not responsible for any external costs incurred by you (e.g., flights or lodging outside the program), so we strongly recommend waiting to book your flights until the trip has been officially confirmed.
6. CANCELLATION & CHANGES
We get it—plans can change. But because your spot on this trip kicks off a chain of commitments (accommodations, partners, logistics), we work with a clear cancellation timeline.
Our refund policy is based on your cancellation date:
More than 150 days before the trip: 80% refund (deposit remains non-refundable).
120–150 days before the trip: 50% refund.
90–120 days before the trip: 25% refund.
Less than 90 days before the trip: No refund possible.
Full refund of the trip price if the minimum requirement of 6 participants is not met.
Substitution Policy: If you cannot attend, you may request to transfer your spot to another individual from the waitlist, subject to our approval. The substitute must meet all eligibility requirements, provide required documents, and agree to these Terms and the Liability Waiver. Substitution requests must be submitted in writing to support@evaandtheplanet.com at least 30 days before the trip start date.
To cancel your booking, send an email to: support@evaandtheplanet.com. Cancellation requests via Instagram DMs or WhatsApp don’t count.
No refunds will be issued for missed flights, personal emergencies, travel delays, illness, or early departure from the trip. In some jurisdictions (e.g., the European Union or Australia), local consumer protection laws may grant additional cancellation rights, which you are responsible for reviewing. That’s why we strongly recommend purchasing comprehensive travel insurance that includes trip cancellation and interruption coverage.
Please note:
Refunds (if applicable) will be processed in USD.
We are not responsible for currency fluctuations, bank fees, or delays in third-party processing.
If you’ve paid in full and need to cancel, any applicable refund is based on the total trip price, not just the balance after deposit.
We reserve the right to cancel your booking if payments are not made on time (see Section 3), or if unforeseen circumstances make your participation unsafe for you or the group.
7. NO GUARANTEES & SERVICE CHANGES
Eva and the Planet does not guarantee that any experience will take place exactly as described. We reserve the right to make changes to accommodations, activities, or the trip itinerary due to unforeseen circumstances, including but not limited to weather, political unrest, third-party availability, or minimum group size not being met.
In rare cases, trips may be canceled. If so, and if the minimum participant requirement was not met, you will receive a full refund of the amount paid. No further compensation will be offered.
8. ITINERARY CHANGES
While we work hard to deliver each experience as planned, unforeseen circumstances may require us to adjust the itinerary. These trips take place in real environments, with real-world variables—and flexibility is part of the adventure.
We reserve the right to modify, replace, or rearrange any part of the trip itinerary at our discretion, at any time before or during the experience, in order to protect the safety, comfort, or enjoyment of the group. This includes (but is not limited to) changes due to weather conditions, natural disasters, transportation delays, political unrest, road closures, partner cancellations, illness, force majeure events, or other unexpected challenges.
We will do our best to communicate changes promptly and to offer reasonable alternatives when possible. However:
No refunds or credits will be issued for modified, delayed, or canceled parts of the itinerary caused by factors beyond our control.
We are not liable for any costs, losses, or inconveniences resulting from itinerary changes, including missed activities, delays, or rebooking expenses.
In some jurisdictions (e.g., the European Union or Australia), local consumer protection laws may require compensation for significant itinerary changes. You are responsible for understanding your rights under applicable law.
By booking a trip with us, you acknowledge that a degree of unpredictability is inherent to travel—and you accept that itinerary changes are sometimes necessary to deliver the safest and most meaningful experience possible.
9. UNUSED SERVICES
We plan each trip down to the detail—for every single traveler. Once your spot is booked, our partners begin preparing for your arrival. That’s why we can’t offer any refunds or discounts for missed experiences, late arrivals, early departures, or unused portions of the trip.
Whether it’s a delayed flight, last-minute schedule change, illness, or something else—if you miss part of the trip, we won’t be able to reschedule or reimburse you.
We strongly recommend purchasing travel insurance that covers delays, cancellations, medical emergencies, and interruptions. It’s optional—but highly advised.
10. LIMITS ON RESPONSIBILITY
You’re in charge of getting yourself to and from the trip. Flights, transport, extra hotel nights, baggage fees, airport snacks—all travel-related costs before and after the official itinerary are on you.
We’re happy to share recommendations or help you plan your journey, but we’re not responsible for any costs you incur outside the trip itself.
If for any reason we need to cancel or reschedule a trip, we’ll notify you immediately and issue any eligible refund according to our policies. But we can’t cover your personal travel expenses, rebooking fees, or other losses tied to changes.
This is why we highly recommend travel insurance that includes trip cancellation and interruption coverage—it helps protect you from unexpected costs.
11. CULTURAL DIFFERENCES, DRUG & ALCOHOL POLICY
Travel means stepping into new worlds—with different norms, laws, and expectations. That’s part of the magic. But it also means respecting the local culture, your fellow travelers, and the communities we visit.
We expect you to act with awareness and respect at all times. That includes how you dress, interact, and carry yourself—especially around topics like alcohol and drugs.
Zero tolerance for drug use. If you use or possess illegal substances during the trip, we reserve the right to remove you from the group immediately—no refunds, no exceptions.
Alcohol is allowed—but stay mindful. We encourage celebration, but not if it compromises your safety or the vibe of the group. Irresponsible behavior that puts you or others at risk can lead to removal from the trip.
You’re also expected to comply with all local laws in every country we visit. We can guide you—but ultimately, you’re responsible for your behavior.
This policy protects you, the group, and the local communities we care about. Travel with openness, but also with integrity.
12. AUTHORITY DURING EXPERIENCES
Our trips are thoughtfully designed—and our team knows the flow, the partners, and the logistics inside out. To make the experience smooth and safe for everyone, we need your trust and cooperation.
By joining a trip, you agree to follow the guidance and decisions of the trip host or any designated team member at all times. That includes changes in schedule, safety instructions, or group dynamics.
If your behavior disrupts the group, causes distress, or puts anyone at risk—we reserve the right to remove you from the trip without refund.
This is about respect. For the group, for the journey, and for the places we visit.
13. FORCE MAJEURE
We do everything we can to plan smooth, meaningful, and unforgettable experiences. But some events are beyond anyone’s control—and when they happen, they impact all of us.
A Force Majeure Event refers to any situation outside of our reasonable control that prevents us—or any of our partners—from delivering the trip as planned. These events can include (but are not limited to): acts of nature (earthquakes, floods, hurricanes), political unrest, terrorism, war, government regulations or restrictions, pandemics, labor strikes, quarantine measures, civil disturbances, or unexpected events like closures, natural disasters, or severe weather conditions.
If a Force Majeure Event occurs, and it affects any part of your trip, we reserve the right to modify, delay, or cancel all or parts of the itinerary—without being held liable for refunds, damages, or any related costs you may incur.
This also applies if our local partners (hotels, transport providers, guides, etc.) are affected by the same. In such cases, we’re not in breach of contract, and no compensation will be owed.
We’ll always try to find the most reasonable and respectful solution—whether that means rescheduling or rerouting—but we ask for your flexibility and understanding in return. These trips are real, on-the-ground experiences—and they require shared responsibility.
Please note: We highly recommend securing travel insurance that includes protection against trip delays, interruptions, or cancellations due to events like these.
14. TRAVEL INSURANCE
We require all travelers to have valid medical travel insurance. This isn’t optional.
Why? Because our trips often take place in remote or rural areas, where medical access may be delayed, limited, or expensive. If you get sick or injured during the trip, you’ll need coverage for:
Emergency treatment.
Hospitalization abroad.
Medical evacuation or repatriation.
Doctor visits and medication.
You must send us proof of active medical travel insurance no later than 45 days before the trip start date—or within one week of booking, whichever is later. Without it, we reserve the right to cancel your spot without refund.
In addition to medical coverage, we strongly recommend you get a broader travel insurance policy that covers:
Trip cancellation or interruption.
Delayed or missed flights.
Stolen or lost luggage.
Personal liability abroad.
In some jurisdictions (e.g., the European Union or Australia), local consumer protection laws may require specific insurance disclosures or coverage. You are responsible for ensuring your policy complies with your local requirements.
This type of coverage protects your financial investment if life throws a curveball. It’s not required, but we’ve seen it save travelers thousands—and headaches—when plans suddenly change.
We’re not responsible for personal losses, travel disruptions, or uninsured medical costs. You are. Make sure your policy fits your trip—and if in doubt, talk to your provider.
15. SUPPLIERS’ CONDITIONS
Eva and the Planet (Werners Visuals LLC) sometimes works with other companies in crafting Experiences. These include, but are not limited to, hotels, local guides, transportation providers, and tour operators. We act as a facilitator, not the direct provider of these services, and local standards in Southeast Asia and Sri Lanka may differ from Western expectations. Although we work hard to ensure a safe journey for our travelers, we cannot control those companies we work with and cannot be responsible for their actions.
Eva and the Planet acts as an agent for transport companies, hotels, and other partners and contractors (“Suppliers”) and is not responsible for any injury, damage, loss, delay, or irregularity that may occur when using the products, services, or accommodations of a Supplier, or due to the negligence, recklessness, omission, oversight, inaction, or other fault of a Supplier, including, but not limited to, any defect in a vehicle or any other form of conveying a traveler, acts of God, detention, delays or expenses arising from quarantine, strike, riots, theft, civil disturbance, government restriction or regulation, accident by aircraft, boat, bicycle, motor vehicle, or any other form of transport, or in any hotel, guest house, hostel, or other form of accommodation.
The quality of the products, services, and accommodations organized by Eva and the Planet are not within the control of Eva and the Planet, and the quality of such products, services, and accommodations may be compromised by local conditions. You therefore release Eva and the Planet from all claims and causes of action arising from any damage, loss of enjoyment, inconvenience, or injuries related to the quality of such products, accommodations, and services.
Airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage. You will be bound by these conditions. Some of these conditions may limit or exclude liability on the part of the relevant transport provider or other Supplier, and they are often also subject to various international conventions. Eva and the Planet’s own liability is limited to and shall not exceed that of its Suppliers. You agree that, if you recover for any damages from the Suppliers, you will not seek any recovery for the same damages from Eva and the Planet.
16. OPTIONAL ACTIVITIES
Our itineraries are crafted with intention—but there will also be room for you to explore on your own.
Any activities you choose to do outside of our official trip itinerary are not part of the experience offered by Eva and the Planet. That means we don’t organize, endorse, or assume responsibility for them—even if we give you local recommendations.
If you decide to join an optional activity or service operated by an independent third party (like a boat ride, massage, local workshop, etc.), you do so at your own risk. We can’t guarantee the safety, quality, or outcomes of any services not included in our program.
By joining such activities, you accept full responsibility for any risks or consequences involved. Our general assumption of risk clause (see Section 1) applies here as well.
17. PHOTOGRAPHY & IMAGES RELEASE
We may hire a professional photographer or videographer to document the experience. These visual moments help us share the spirit of our journeys and the beauty of the places we visit. By joining the trip, you acknowledge and agree to the following terms.
The photographer will own the rights to any images, photos, or videos (“Content”) taken during the experience. You may use this Content for personal, non-commercial purposes only. If you share Content publicly (e.g., on social media or personal blogs), you agree to credit the photographer appropriately by name and copyright.
You agree that Eva and the Planet and our agents, suppliers, vendors, and collaborators (including photographers and videographers) have a worldwide, royalty-free, perpetual license to use, reuse, distribute, display, create derivative works of, and reproduce any images, photos, or videos—whether directly or through a photo-sharing service—in any format or medium, including but not limited to print, online platforms, and promotional materials, without compensation or prior approval.
You also acknowledge and agree that images, videos, or recordings created during the trip may include your name, likeness, voice, or statements. You grant Eva and the Planet a perpetual, royalty-free, worldwide, irrevocable license to use such materials for any purpose, including marketing, publicity, and future travel promotion.
By participating, you waive any right to inspect or approve the use of these materials, and release Eva and the Planet and its partners from any claims arising from their use.
18. COMPLAINTS & CLAIMS
We genuinely care about your experience—and we want to know if something didn’t meet expectations. We rely on strong local partnerships and do our best to ensure quality, safety, and care throughout your journey.
If you experience any issues during the trip, you agree to bring them to our attention immediately—by informing your trip host or a member of our team on the ground. This gives us the chance to support you and, when possible, address the situation in real time.
If you wish to file a formal complaint or request compensation after your trip, you agree to do so by email to support@evaandtheplanet.com within 30 days after the trip ends. Any supporting documentation must be included in your message. Complaints received after this window may not be considered.
In some jurisdictions (e.g., the European Union or Australia), local consumer protection laws may grant additional rights to file complaints or seek remedies. You are responsible for understanding your rights under applicable law.
We appreciate your honesty and take all feedback seriously—and we’ll always do our best to respond with fairness and care.
19. INDEMNIFICATION & LIMITATION OF LIABILITY
By booking a trip with Eva and the Planet (Werners Visuals LLC), you agree to indemnify, defend, and hold harmless Eva and the Planet, Werners Visuals LLC, and its team, officers, contractors, affiliates, suppliers, and partners (“Us”) from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
Your participation in the trip.
Your breach of these Terms.
Your violation of any law or the rights of any third party.
Your negligent or intentional misconduct.
This includes (but is not limited to) damage to property, personal injury, medical costs, legal fees, or liabilities caused to third parties by your actions.
Our total liability for any claim arising from or related to your trip shall not exceed the amount you paid us for that trip. We are not liable for indirect, incidental, special, punitive, or consequential damages of any kind—even if we have been advised of the possibility of such damages—to the fullest extent permitted by applicable law.
20. WEBSITE USE & LIMITATION OF LIABILITY
Eva and the Planet does not guarantee uninterrupted or error-free access to its website or booking links. While we strive to maintain a reliable online presence, technical issues, maintenance, or third-party outages may occur.
We are not liable for any direct or indirect damages arising from website downtime, functionality errors, or delayed access, including failure to complete a booking.
You agree to use this website only for lawful purposes and in accordance with these Terms and Conditions. You must not misuse the site or its content in any way, including for fraudulent activity, unauthorized data collection, or unlawful communication. Any violation may result in legal action and immediate suspension of access.
21. THIRD-PARTY PLATFORMS & WETRAVEL
We use third-party platforms like WeTravel to manage payments and bookings. By booking a trip through WeTravel, you also agree to their terms, privacy policies, and payment processing rules. These are separate from our own Terms & Conditions, and we are not liable for actions or policies controlled by these platforms.
Digital products purchased through a Merchant of Record (e.g., LemonSqueezy or ThriveCart) are subject to the terms and conditions of those platforms. Eva and the Planet’s liability for such products is limited to the content or service provided, not payment or delivery processes handled by the Merchant of Record.
22. SEVERABILITY
If for any reason a court or legal authority finds any part of these Terms to be invalid, unenforceable, or in conflict with applicable law, that specific provision will be adjusted or removed—but the rest of the Terms will stay in full effect.
This means: just because one clause doesn’t hold up legally doesn’t mean the rest of our agreement is void. All remaining provisions will continue to apply and remain legally binding.
23. SUCCESSORS & ASSIGNS
This Agreement will be to the benefit of and be binding upon Werners Visuals LLC, You, and both parties’ respective heirs, legal personal representatives, successors, and assigns.
24. ENTIRE AGREEMENT
This is the entire agreement between Werners Visuals LLC and you as to any and all bookings, reservations, Experiences, trips, or transactions made with Werners Visuals LLC, and constitutes a binding agreement. You agree that there are no verbal or written representations, warranties, collateral agreements, or terms or conditions other than as expressed in these Terms.
25. APPLICABLE LAW AND CHOICE OF FORUM
This Agreement shall be governed by, and construed in accordance with, the laws of the State of Florida, without regard to applicable conflict of law provisions, to the fullest extent permitted by law. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in the State of Florida, unless local consumer protection laws in your country of residence (e.g., the European Union or Australia) mandate otherwise.
When we refer to “Werners Visuals,” “we,” or “our,” this includes our officers, directors, contractors, agents, employees, and any affiliated, associated, or otherwise connected entities—as well as their respective successors and assigns.
